Terms & Conditions for Business Connect Nationwide

Limited-time offer for ATMC business customers only. Subject to availability. ATMC reserves the right to limit or discontinue this bundle offer without notice or restriction. ATMC Business Connect Bundles may not be combined with any other discount offers for the same services. Pricing requires one- or two- year service agreement as indicated on the attached Business Services Agreement. ATMC Business Connect Bundle pricing refers to the recurring monthly rate with service agreement before taxes and fees. Bundle price includes primary line and one secondary line (Primary Bundle). Additional lines (Additional Bundle Lines) may be added to the bundle for a monthly charge.

Payment - Customer is responsible for paying all charges for or resulting from services provided under this Agreement. Customer will receive monthly bills that are due in full as shown thereon. Customer must pay by the due date, or notify ATMC in writing at ATMC, PO BOX 3198, SHALLOTTE, NC 28459 of any dispute Customer has with respect to the bill, including any charges on the bill and any service ATMC provided for which Customer was billed, or Customer will have waived their right to dispute the bill or such services to bring, or participate in, any legal action raising and such dispute. Charges include, without limitation, recurring monthly service, activation, administrative, and late payment charges; regulatory cost recovery and other surcharges; optional feature charges or calls billed to your phone number; and applicable taxes and governmental fees, whether assessed directly upon you or upon ATMC.

Cancelation - You may cancel or downgrade any or all services prior to completing the term agreement. However, upon cancelation of Bundle Services, an Early Termination Fee will apply, bundle pricing is void and remaining services will be billed at current retail rates. Throughout the term of the agreement, customer must maintain the Primary Bundle (Primary Line and secondary line) or early termination fee applies.

Early Termination Fee - A $200 early termination fee applies if the Primary Bundle service is disconnected prior to completing the term agreement. A $100 early termination fee per line applies to each Additional Bundle Line disconnected prior to completing the term agreement. Additional Bundle Lines added subsequent to the initial date the Primary Bundle was added to the Customer's account will be required to remain on the account until the end of the service agreement term of the Primary Bundle or a cancelation fee applies.

Bundle Plan Requirements: Telephone call features and long distance are shared across all lines, with a maximum of 10 lines. All Primary Bundle lines and Additional Bundle Lines must be billed on the same customer account and in service at the same physical address. All lines in either hunt/rotary or terminating to a business telephone system must be a part of the Primary Bundle or an Additional Bundle Line. By subscribing to an ATMC Business Connect Bundle, you are agreeing and designating ATMC as your long distance carrier for all jurisdictions.

Unlimited Long Distance Plan Restrictions: Long distance is intended for typical domestic business voice usage only: direct-dialed, one-plus business voice use only within the U.S. and its select territories. Business Unlimited Long Distance Plan services are provided solely for live dialog between two individuals. Unlimited voice services may not be used for conference calling, call forwarding, monitoring services, data transmissions, transmission of broadcasts, transmission of recorded material, auto-dialing (including automatic outbound dialing systems or call distribution systems), broadcast fax, PBX, PBX-like, data transmission or any similar equipment, long-distance Internet or intranet access, fax machines, broadcast fax transmissions, softphones or data devices, transcript services, telemarketing, multi-party conferencing calling (excluding 3-way calls), party lines, chat lines, directory assistance, calling card, operator services, adult entertainment lines, calls to 900 and 976 numbers, call centers and certain switching applications, Centrex, foreign exchange, public telephone or ISDN services, PRI or the equivalents of any such services or other connections which do not consist of uninterrupted live dialog between two individuals.

Aggregate Traffic, Resale and Excessive Use Restrictions: Customer lines associated with education institutions (colleges, Universities, etc.) or other businesses that aggregate end user traffic are not eligible for this plan. Plan cannot be used for resale. Additionally, usage not consistent with typical domestic business voice usage occurs when, for a period of two consecutive months, a customer's average monthly minutes of use under the Business Unlimited Long Distance Plan is more than twice the monthly average minutes of use of all other customers with the Business Unlimited Long Distance calling plan.

Other Terms and Conditions - Additional charges apply for directory assistance, calling cards, collect calls, operator services, international calling and/or toll-free calling services.

Termination - If ATMC finds that you are using an unlimited voice service offering for purposes other than live dialog between two individuals, or for calls that do not qualify for Unlimited Voice Services as stated above, ATMC may, at its option terminate your service or change your plan to one with no unlimited usage components. ATMC will provide notice that it intends to take any of the above actions, and you may terminate the agreement.

Term Completion - Upon completion of the initial term agreement, ATMC reserves the right to increase your monthly fee. Any such fee increase will be described in a notice sent approximately 30 to 60 days before the increase goes into effect.
